Refund & Return Policy

This Refund & Return Policy (“Policy”) applies to all purchases made from Nim&Co, LLC, a Texas limited liability company doing business as the Manav® (“we,” “us,” or “the Manav”), operating from Houston, Harris County, Texas. By placing an order you acknowledge that you have read, understood, and agreed to this Policy, which is drafted in accordance with the Texas Business & Commerce Code (including the Texas Deceptive Trade Practices – Consumer Protection Act, Chapter 17) and applicable federal food-safety regulations.
1. Merchant Disclosure (Texas Bus. & Com. Code § 17.46)
In accordance with Texas retail return disclosure requirements, this Policy is conspicuously posted on our website, on every product page, during checkout, and in each order confirmation email. By completing a purchase you confirm that this Policy was available to you prior to payment.
2. 7-Day Satisfaction Guarantee
If your order arrives damaged, incorrect, or defective, contact us within seven (7) calendar days of delivery and we will make it right with either a replacement shipment or a full refund, in accordance with Section 6 below.
To file a claim, email support@themanav.com with:
- Your order number
- Clear photo(s) of the product and its outer packaging
- A brief description of the issue
3. Items Eligible for Return
Unopened, non-perishable dry goods still within their “best by” date may be returned within fourteen (14) calendar days of delivery, including:
- Sealed biscuits, wafers, chocolate, and candy
- Sealed pantry staples (bulgur, rice, lentils, pasta)
- Sealed spices, teas, and coffee
- Sealed packaged snacks
Return shipping is the customer’s responsibility unless the return results from our error (damaged, defective, or incorrect item).
4. Items NOT Eligible for Return (Food-Safety Exclusions)
Pursuant to the Texas Food, Drug & Cosmetic Act (Tex. Health & Safety Code, Ch. 431) and 25 Tex. Admin. Code Ch. 229, the following cannot be returned for health and safety reasons:
- Any opened, damaged-by-customer, or partially used product
- Refrigerated, frozen, or temperature-sensitive items
- Freshly baked goods, dairy, or any perishable product
- Products past their “best by” or expiration date at the time of return
- Final-sale and clearance items
- Gift cards
These items may, however, qualify for a refund or replacement under Section 2 if the defect is ours.
5. Damaged, Defective, or Missing Items
If an item arrives broken, crushed, leaking, or is missing from your shipment, notify us within forty-eight (48) hours of delivery with photos. We will ship a replacement or issue a full refund (including paid Texas sales tax) at no additional cost to you.
6. How Refunds Are Issued
Approved refunds are processed to the original payment method within five to ten (5–10) business days after we receive the returned item or approve the claim. In compliance with Texas Tax Code § 151.430, any Texas state and local sales tax paid on returned items is refunded together with the product price. Original shipping fees are refunded only when the return is due to our error.
7. Order Cancellations
Orders may be canceled free of charge before they are packed for shipment. Once an order has been packed or handed to the carrier, cancellation is no longer available, but eligible items may be returned under Sections 3–5 once received.
8. Address Accuracy & Undeliverable Packages
Please verify your shipping address at checkout. Nim&Co, LLC is not responsible for orders delivered to an incorrect address supplied by the customer. If the carrier returns the package to us as undeliverable, you may choose between re-shipment at your cost or a refund of the product total (excluding shipping).
9. Consumer Rights Under Texas Law
Nothing in this Policy is intended to waive or limit any non-waivable consumer right you may have under the Texas Deceptive Trade Practices – Consumer Protection Act (Tex. Bus. & Com. Code Ch. 17, Subch. E) or any other applicable law. If any provision of this Policy is found unenforceable, the remaining provisions remain in full force.
10. Governing Law & Venue
This Policy is governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue for any claim, dispute, or action arising out of or related to your purchase shall be the state or federal courts located in Harris County, Texas. Both parties consent to personal jurisdiction in those courts.
11. Dispute Resolution
Before filing any formal action, please contact us so we can try to resolve the issue informally. If we cannot reach a resolution within thirty (30) days, either party may pursue remedies available under Texas law, including mediation or arbitration where appropriate.
